Welcome to theyukontrader.com Agreement (the “Agreement”). This Agreement outlines the terms and conditions of your access to our services available under theyukontrader.com (the “Site”). If you do not agree to the terms and conditions outlined in this Agreement, do not use the Site or access our services. You must read, agree with and accept all of the terms and conditions contained in this Agreement before you may become a member of theyukontrader.com. This includes both the terms and conditions expressly set out and those incorporated by reference. We reserve the right to amend this Agreement at any time by posting the amended terms on our Site. Amended terms shall become effective immediately after they are posted on our Site. In addition, we will notify you via the email address that you registered with. This Agreement may not be amended except in a writing signed by both you and theyukontrader.com. This Agreement is effective upon acceptance in registration for new registering users and is otherwise effective on April 16, 2023 for all users registered.

Fees and Services:
At theyukontrader.com, you can join, post, and view most ads without any fees. However, we do require a nominal fee for posting ads in specific categories or utilizing certain features on our site. When you list an item, you will have the opportunity to review and accept the corresponding fees. We reserve the right to modify or discontinue any of our services at our sole discretion. Any new services introduced will have fees effective from their launch. Unless otherwise specified, all fees are quoted in Canadian Dollars. Please note that you are responsible for paying all fees associated with using our website, as well as any applicable taxes

Posting or Selling:
You must be able to successfully sell any item that you post for sale on this website. You should provide a detailed description of the item and list all relevant terms of the sale on the posting page. Only include text, graphics, pictures, and other content related to the item when posting. Additionally, make sure that the item is posted in the appropriate category.

Notification:
You agree to receive notification emails from theyukontrader.com periodically to inform you about new features, updates, and important announcements about the service. These emails will help keep you up-to-date regarding any changes or additions to the platform.

Your Information:
3.1 Definition.”Your Information” refers to any information you provide to us or other users during the registration or posting process, or through any email feature. You are solely responsible for the accuracy and accuracy of Your Information, and we act as a platform for you to distribute and publish Your Information online.

3.2 Restricted Activities. Your activities on the Site and the Information (or any items posted) must not:
(a) Be false, inaccurate or misleading in any way;
(b) Involve the sale of counterfeit or stolen items; (
c) Infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
(d) Violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, antidiscrimination or false advertising);
(e) Be defamatory, trade libelous, unlawfully threatening or unlawfully harassing;
(f) Be obscene or contain child pornography or, if otherwise adult in nature or harmful to minors, shall not be posted;
(g) Contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
(h) Create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
(i) You are not allowed to link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement. Additionally, you may not list any item on the Site (or make any transaction through our service) that could potentially cause us to break any applicable laws, statutes, ordinances, or regulations by paying the posting fee.

3.3 Licence. By agreeing to the terms of this license, you are granting us the right to use the information you provide to us without violating any of your rights, including the copyright and publicity rights, associated with the information. We will not use your information for any purpose other than what is stated in our Privacy Policy. The rights you are granting us are non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sublicenseable (meaning that we can give permission to others to use your information too). Additionally, you are waiving all moral rights you have to the information in question.

Breach:
If you breach this Agreement, we may take any of the following actions, without limiting any other remedies available to us: immediately removing your item postings, warning our community of your actions, issuing a warning, temporarily suspending, indefinitely suspending, or terminating your membership, and/or refusing to provide our services to you. This may be the case if we are unable to verify or authenticate any information you provide to us, or if we believe that your actions may cause financial loss or legal liability for you, our users, or us.

Privacy
You acknowledge that you have reviewed and accepted our Privacy Policy, which outlines how we collect, use and disclose your personal information. This policy only applies to theyukontrader.com, and not to other users of the Site. Therefore, it is important to be cautious when posting personal information on the Site that you do not want to be shared with others, and limit the transmission of contact information to only an email address or another way in which a person responding to your classified can reach you.
We reserve the right to reveal any information received regarding suspected or alleged fraudulent or illegal activity to the appropriate authorities.

No Warranty:
We, our parent, subsidiaries, officers, directors, employees, and suppliers provide our website and services “as is” without any representation, warranty, condition, express, implied, or statutory. This means we make no guarantees about the quality, functionality, or accuracy of our website and services. We and our suppliers specifically disclaim any implied representations, warranties of title, merchantability, merchantable quality, fitness for a particular purpose, and non-infringement, and those arising by law or through a course of dealing or usage of trade, unless specifically required by law.

No Liability:
We, our parent, subsidiaries, officers, directors, employees, and suppliers cannot be held liable for any lost profits, special, incidental, consequential, indirect, or punitive damages related to our site, services, or this agreement.

Indemnity:
You agree to protect and defend us and our parent, subsidiaries, affiliates, officers, directors, agents, and employees from any claims or demands, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. You will be responsible for any costs incurred as a result of your breach of this Agreement.

Legal Compliance:
You must follow all applicable laws, rules, and regulations when using our service and when listing, purchasing, offering to purchase, or selling items. This includes obeying all local, state, national, and international laws. Failure to do so may result in legal consequences.

No Agency:
You and theyukontrader.com are independent contractors, meaning that no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship exists between the two of you. This Agreement does not establish any of the aforementioned relationships.

Resolution of Disputes:
In the event of a dispute between you and theyukontrader.com, we aim to provide an efficient and cost-effective method for a resolution. Any claims or controversies that arise out of this Agreement or our services (“Claims”) will be dealt with by both parties in writing. We urge you to contact us directly to seek a resolution and we are willing to consider reasonable requests to settle the dispute through alternative dispute resolution methods, such as mediation, rather than litigation.

General:
This Agreement is governed by the laws of Yukon Territories and the federal laws of Canada applicable therein. theyukontrader.com is not responsible for any interruption of or interference with our services. If any provision of this Agreement is found to be invalid or unenforceable, that provision will be removed and the remaining provisions will still be enforced. theyukontrader.com may assign this Agreement and any of the terms and conditions in it, in its sole discretion. Headings are for reference only and do not limit or describe the scope of the sections. Our failure to act on a breach of this Agreement by you or others does not prevent us from taking action on any other or similar breach. This Agreement sets out the entire understanding and agreement between us with respect to the subject matter. The sections of the Agreement regarding fees for our services, license, no warranty, no liability, indemnity and resolution of disputes will all survive any termination or expiration of this Agreement.

Contracts in English:
The parties involved wish for any documents relating to this agreement and any related documents to be written and signed in English. If any disputes arise between you and theyukontrader.com in regards to the Site, you are encouraged to report them to Customer Support. We also suggest that you report any user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration service.
